CFTC and SEC Advance Crypto Regulatory Discussions Amid Legislative Stasis

The US Commodity Futures Trading Commission (CFTC) has scheduled a committee meeting to discuss policy issues, including potential approaches to cryptocurrency regulation. This initiative comes in the absence of definitive congressional action on the matter.

CFTC Meeting Agenda

The CFTC announced a meeting for its Innovation Advisory Committee on August 20. The agenda includes discussions on regulatory frameworks for crypto assets, artificial intelligence, and prediction markets. Regarding cryptocurrency, the committee plans to explore regulatory actions that could supplement future congressional legislation, particularly after the US Senate did not advance the Digital Asset Market Clarity (CLARITY) Act prior to its August recess.

SEC's Parallel Approach

This development follows a similar announcement from the US Securities and Exchange Commission (SEC), which also scheduled a meeting to discuss new rules for a tailored offering regime for certain investment contracts involving crypto assets. An SEC spokesperson indicated the agency's support for a market structure bill from Congress, but affirmed that the SEC would proceed with crypto regulation within its existing authority until such legislation is enacted.

CFTC Leadership Status

Michael Selig currently serves as the sole Senate-confirmed CFTC commissioner and chair. There has been no indication from President Donald Trump regarding additional nominations to fill the remaining leadership positions at the agency. Although other CFTC staff will participate in the August 20 meeting, the lack of a full panel of five bipartisan commissioners has prompted calls from lawmakers for presidential action.
